Acceptance of these terms

By creating a Marketing AI account, requesting a callback, or otherwise using the Marketing AI service, you agree to these Terms of Service. If you do not agree, do not use the service.

If you are using Marketing AI on behalf of a company or other organization, you represent that you have authority to bind that organization to these terms, and "you" refers to both you and that organization.

What Marketing AI does

Marketing AI is a marketing service delivered as software. We run audits, generate briefs and drafts, manage campaigns across Google, Meta, and TikTok, validate schema, produce ad-video creative, and report on performance. Senior judgment is the product. Drafts are how we get there.

Hosted plans (Solo, Growth, Agency)

Hosted plans run on Marketing AI infrastructure. You connect your channels via OAuth and we deliver the work through your workspace. Your workspace data is processed on our cloud subject to the Privacy Policy.

Enterprise (on-prem)

Enterprise deployments run inside your own cloud or on-prem infrastructure. Your workspace data does not leave your network. Enterprise terms are governed by a separate signed agreement that supplements these terms; where there is conflict, the signed Enterprise agreement controls.

Account and eligibility

  • You must be at least 18 years old to use Marketing AI.
  • You must provide accurate information when you create an account.
  • You are responsible for maintaining the security of your account credentials, including OAuth tokens issued to Marketing AI by your channel platforms.
  • You must notify us promptly if you believe your account has been compromised.
  • One person may hold one account. Multiple seats per plan are governed by your tier.

Payment, billing, and overage

Hosted plans are billed monthly or annually in advance, in US Dollars, via Stripe. We do not store credit card or bank account details - Stripe handles that under their own security and compliance program.

Annual plans

Annual plans bill the full annual amount up front. The monthly equivalent is shown on the pricing page for comparison. Annual plans renew automatically on the anniversary date unless cancelled before the renewal date.

Ad-video overage

Each plan includes a monthly cap on ad-video generation. Overage is on by default at $5 per extra video, billed on your next invoice. You can switch overage off in account settings, in which case generation stops once you hit your tier cap until the next billing cycle.

Managed ad spend caps

Each plan caps the total monthly ad spend across the Google, Meta, and TikTok accounts Marketing AI actively manages. The cap is enforced softly - we will reach out before any account stops working - so an unexpected spike does not break your campaigns.

Taxes

Listed prices exclude taxes. You are responsible for any taxes that apply to your purchase, including sales tax, VAT, or GST, except for taxes on Marketing AI's net income.

Failed payments

If a payment fails, we will retry over the following days and email you. If payment cannot be collected, your account may be suspended until billing is current. Workspace data is preserved for 30 days during suspension.

Cancellation and termination

You can cancel any time

Cancel from your account settings or by emailing Sam. Monthly plans end at the close of the current billing cycle. Annual plans run to the end of the prepaid term and do not auto-renew once cancellation is recorded.

We may suspend or terminate accounts

We may suspend or close accounts that violate the acceptable use policy below, fail to pay, or otherwise materially breach these terms. Where appropriate, we will give notice and a chance to fix the issue first.

What happens to your data

On cancellation, you can export your audits, briefs, and reports from inside the workspace at any time before deletion. Hosted-plan workspace data is deleted within 30 days of account closure, as described in the Privacy Policy.

Acceptable use

You agree not to use Marketing AI to:

  • Break the law, infringe rights, or violate the policies of any platform you connect (Google, Meta, TikTok, etc.).
  • Generate, distribute, or amplify content that is fraudulent, defamatory, or designed to harass, harm, or deceive a person or organization.
  • Run campaigns for content that violates platform ad policies (illegal goods, deceptive practices, scams, prohibited categories).
  • Reverse-engineer the service, attempt to extract source code, or bypass rate limits or security controls.
  • Resell, sublicense, or repackage Marketing AI as your own product without a written reseller agreement.
  • Use the service to compete with Marketing AI by training a competing AI marketing system on outputs.

Agency and reseller arrangements are welcome and supported - the Agency tier is built for it. Just talk to us first.

Ownership of data and outputs

You own your data

You retain all rights to the data you provide to Marketing AI, including channel data accessed through OAuth and any inputs you upload (brand assets, prompts, source material).

You own the outputs

Audits, briefs, drafts, schema, ad-video creative, and reports that Marketing AI generates from your data are yours. You can export, edit, publish, license, or otherwise use them however you like.

We own the platform

We retain all rights to Marketing AI itself - the software, prompts, models we develop, infrastructure, and brand. Nothing in these terms transfers ownership of the platform to you.

Limited licence we need from you

To deliver the service, you grant us a worldwide, royalty-free, non-exclusive licence to host, process, transmit, and display your data and inputs strictly for the purpose of operating Marketing AI for you. This licence ends when your account ends and the data is deleted.

No model training on your data

We do not use your workspace data to train AI models. Anthropic and OpenAI also do not train on data sent through their APIs by default; we keep their training opt-outs enabled.

AI outputs and human approval

Marketing AI uses AI to generate drafts, recommendations, and creative. AI outputs are drafts - they may contain inaccuracies, miss context, or fail to anticipate edge cases.

By default, your team is responsible for reviewing and approving every draft, fix, schema change, and campaign edit before it publishes or goes live. The approval queue cannot be silently bypassed by the platform. Teams who prefer ungated launches can opt into auto-publish from account settings; the choice is explicit and reversible. You retain full editorial and publishing control either way.

You agree not to rely on AI outputs as legal, financial, medical, or professional advice. Where regulated copy is involved (legal disclaimers, medical claims, financial advice, advertising rules), your team is responsible for the final review.

Third-party services

Marketing AI integrates with third-party services to deliver its work, including Stripe (billing), Anthropic and OpenAI (AI), Ahrefs (keyword and link data), and channel platforms (Google, Meta, TikTok, GSC, GA4) via OAuth.

Your use of those services is governed by their own terms and policies. We are not responsible for outages, policy changes, account suspensions, or other actions taken by third-party providers, but we will help you work through them where we can.

Warranty disclaimer

Marketing AI is provided on an "as is" and "as available" basis. We do our best to make the service reliable, accurate, and useful, and our roadmap reflects that, but we do not warrant that it will be uninterrupted, error-free, or that AI outputs will be perfect.

To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow these disclaimers - in those places, our warranties are limited to the minimum required by law.

Limitation of liability

To the maximum extent permitted by law, Marketing AI's total liability arising out of or related to these terms or the service is limited to the fees you paid to us in the twelve months preceding the event giving rise to the claim.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or business interruption, even if we were advised of the possibility.

These limits do not apply where prohibited by law (for example, gross negligence, willful misconduct, or liability that cannot be limited under consumer protection statutes).

Indemnification

You agree to defend and indemnify Marketing AI against third-party claims arising from your misuse of the service, your content, your violation of platform policies, or your breach of these terms. Marketing AI agrees to defend and indemnify you against third-party claims that the platform itself (excluding your content and configuration) infringes a third party's intellectual property, subject to the liability cap above.

Changes to these terms

We may update these terms when our practices change. Material changes will be emailed to active accounts at least 30 days before they take effect. Non-material changes (typos, clarifications) take effect with no notice. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of Marketing AI after a change becomes effective constitutes acceptance of the updated terms.

Governing law and disputes

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law principles. The exclusive venue for any disputes is the state and federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
